These Terms of Service apply to purchases made from Brush & Kin Studio through brushandkin.com. By visiting our website or placing an order, you agree to these terms.
- STORE INFORMATION
Brush & Kin Studio is an Australian-owned online business offering made-to-order apparel, accessories and custom-designed products.

2. PRODUCTS
We make reasonable efforts to display product descriptions, colours, sizing and images accurately. Colours may appear slightly different depending on your screen, and minor variations can occur through the printing and manufacturing process.
These reasonable production variations do not exclude your rights if a product is faulty, substantially different from its description or otherwise fails to meet an applicable consumer guarantee.
Products are subject to availability. We may update or discontinue products and variants when necessary.
3. ORDERS AND PAYMENTS
Submitting an order is an offer to purchase the selected products. An order is accepted when payment is successfully processed and the order is confirmed.
Prices are displayed in the currency selected or shown at checkout. Any shipping charges, taxes or duties that we collect will be displayed before payment.
If an item becomes unavailable, contains an obvious pricing error or cannot be fulfilled, we may contact you, cancel the affected item and provide a refund.
You are responsible for ensuring that your contact, delivery and order information is accurate before submitting your order.
4. MADE-TO-ORDER PRODUCTS
Our products are produced specifically for each order. Production may begin shortly after an order is confirmed.
Requests to change or cancel an order must be sent immediately to support@brushandkin.com. We will attempt to accommodate the request, but changes or cancellations cannot be guaranteed after production begins.
5. CUSTOM AND PERSONALISED DESIGNS
Customers must provide clear, accurate and suitable photographs, names, wording and other requested information.
Where a design proof is supplied, you are responsible for checking spelling, layout, colours and other visible details before approval. Production may begin after approval is received.
We may decline content that is unlawful, abusive, offensive, misleading or reasonably suspected of infringing another person’s intellectual-property or privacy rights.
6. CUSTOMER-SUPPLIED CONTENT
You retain ownership of photographs and other original material that you supply.
By submitting content, you confirm that you own it or have permission to use it for the requested product. You grant Brush & Kin Studio and its fulfilment partners a limited permission to reproduce and process that content solely to create, fulfil and deliver your order.
Customer photographs will not be used publicly for advertising or promotional purposes without permission.
Unless otherwise agreed in writing, purchasing a custom product does not transfer ownership of Brush & Kin Studio’s original artwork, design methods, editable files or other intellectual property. Your purchased physical product is for personal use, and the underlying artwork must not be commercially reproduced without written permission.
7. SHIPPING AND DELIVERY
Production and delivery times are estimates rather than guaranteed dates. Delivery may be affected by the destination, carrier delays, customs processing, weather, public holidays or other circumstances outside our reasonable control.
Customers are responsible for supplying a complete and accurate delivery address. Please contact us immediately if an address needs to be corrected.

8. RETURNS AND REFUNDS
Returns, replacements, cancellations and refunds are handled in accordance with our Return and Refund Policy and applicable consumer law.
Nothing in these terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded.
9. INTELLECTUAL PROPERTY
Unless otherwise stated, the Brush & Kin Studio name, branding, website content, product artwork, graphics and original designs belong to Brush & Kin Studio or are used with permission.
You may not reproduce, sell, distribute, modify or commercially exploit this material without written permission.
10. ACCEPTABLE USE
You must not use our website:
• For unlawful or fraudulent purposes.
• To infringe another person’s intellectual-property or privacy rights.
• To transmit harmful code or interfere with the website’s operation.
• To submit false, misleading, abusive or harmful content.
• To attempt unauthorised access to our systems or another customer’s information.
11. THIRD-PARTY SERVICES
Our store and payments are supported by Shopify, and products may be manufactured and shipped by third-party fulfilment providers, including Printify and its printing partners.
These providers may process information necessary to complete payments, manufacture products, fulfil orders and arrange delivery. Personal information is handled according to our Privacy Policy and the applicable provider’s privacy practices.
12. CONSUMER RIGHTS
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
Depending on the circumstances, customers may be entitled to a repair, replacement, refund, cancellation or compensation when goods or services do not meet applicable consumer guarantees.
Nothing in these terms limits any mandatory rights available under the Australian Consumer Law or another applicable consumer-protection law.
13. LIABILITY
To the maximum extent permitted by law, Brush & Kin Studio is not responsible for loss caused by misuse of a product, inaccurate information supplied by a customer, or events outside our reasonable control.
This section does not exclude liability that cannot lawfully be excluded.
14. CHANGES TO THESE TERMS
We may update these terms to reflect changes to our products, services, business operations or legal obligations. The current version will be published on this page with its updated date.
Changes will not remove rights that have already arisen under an accepted order or applicable law.
15. GOVERNING LAW
These terms are governed by the laws of South Australia and Australia. Mandatory consumer rights that apply in a customer’s location remain unaffected.
